For married couples:

• Applications to a court for a property settlement must generally be made within twelve months of a divorce order becoming final.

For de facto (including same sex couples):

• Applications to a court for a property settlement must generally be made within two years of separation.

In some circumstances the court may grant leave for an application to be issued out of time.
