One or both parties to a marriage can apply for a divorce if there has been an irretrievable breakdown of a marriage. The only way to establish this is by twelve (12) months separation. A divorce cannot be obtained faster by alleging that one party has caused the separation.

Most of our clients apply for their own divorces and seek our help to resolve parenting and financial issues.

We can help you if you prefer not to do your own divorce. You may need our help if, for example:

  • You and your spouse have separated under the one roof;
  • You have not sorted out your financial/property arrangements;
  • You are unhappy with the parenting arrangements;
  • You do not know how to serve documents on your spouse.

The divorce process usually takes six to ten weeks from the time the application for divorce is filed with the Court.

It is important to note that unless you obtain leave from the Court an application for property or spousal maintenance orders must be made within twelve (12) months from the date of divorce.
